Part 1 - The People vs City Hall: How far should NEW oil operations be away from residential issues?



ISSUE:

The appropriate distance of new oil wells should be from residential uses.


FACTS:

Historically, the City of Carson had one of the most permissive oil codes in the State of California. The entire ordinance was two-pages long and gave wide discretion to oil production operators.


The City of Carson engaged in an EIGHT-MONTH process with outside consultants to develop one of the most comprehensive oil codes in California. One of the most contentious aspects of the oil code was the appropriate distance NEW Oil operations should be away from Homes.


The vast majority of the public comment supported a 1500-foot distance. The staff report and City paid consultants STRONGLY advocated for a 500-foot distance.


On 10/13/15, the Planning Commission voted. Commissioner Thomas suggested an array of motions for each item, starting at 500 and working upward until there is a majority vote. Chairman Diaz concurred.


(1) Commissioner Thomas moved, seconded by Commissioner Post, to approve a 500-foot setback. This motion failed as follows, 3-6: AYES: Faletogo, Madrigal, Newcombe NOES: Andrews, Diaz, Guidry, Mitoma, Post, Thomas ABSTAIN: None ABSENT: Schaefer


(2) Commissioner Thomas moved, seconded by Commissioner Post, to approve a 750-foot setback. This motion failed as follows, 4-5: AYES: Diaz, Faletogo, Madrigal, Newcombe NOES: Andrews, Guidry, Mitoma, Post, Thomas ABSTAIN: None ABSENT: Schaefer


(3) Commissioner Thomas moved, seconded by Commissioner Post, to approve a 1,000-foot setback. This motion carried as follows, 6-3: AYES: Faletogo, Guidry, Mitoma, Newcombe, Post, Thomas NOES: Andrews, Diaz, Madrigal ABSTAIN: None ABSENT: Schaefer


On 11/24/15, the Carson Planning Commission met to ratify the 10/13/15 vote. Despite voting for the 1000-foot distance, the City Staff and Consultants AGAIN STRONGLY advocated for a 500-foot distance. (THIS VIDEO)


After much debate, the 1000-foot distance was maintained. AYES: Fe’esago, Guidry, Mitoma, Newcombe, Palmer, Post NOES: Chairman Diaz, Madrigal
